So what if it was? Hate is just an emotion/feeling. It shouldn't be illegal to have ANY emotion or feeling. By charging someone with a hate crime you're giving them additional punishment for how they felt or thought. It should only be illegal to act on emotions and feelings, it's the actions that are the problems and should be punished not the emotions or feeling behind them.

A hate crime is the result of someone acting on his/her emotion. Hate crime laws are not anti-emotion laws.

We already charge people for criminal actions. Adding the hate crime gives an additional or harsher punishment just because the crime was motivated by hate, so yes, it is very much an anti-emotion law.

It seems to me the issue is if the fullest extent of the law isn't enough for certain crimes already on the books then stiffer penalties need to be enacted. I'm not sure a whole new class of crime needs to be created.

It is enough to punish the act. Using motivation to determine guilt is one thing, making motivation in itself a crime is completely unreasonable.

The problem is that "motivation" cannot always be used to determine guilt.

There are all sorts of new problems like "social justice warriors"
infiltrating a Jury to throw a trial into contempt by only always
delivering an "innocent" verdict no matter what the circumstances
of the case or trial might be.

In my view hate crime laws are poorly conceived and unnecessary in any case but at least they're being consistent here in charging the black perpetrators.
